Intellectual Property & Ownership Policy

01 Policy Overview

This policy applies to websites, web applications, portals, e-commerce websites, WordPress websites, custom software, UI/UX designs, graphics, programming work, source code, documentation, and other digital deliverables developed or supplied by WEB INDIA WEB MULTI SERVICES.

Ownership and usage rights may vary depending on whether an item is specifically created for the client, supplied by the client, licensed from a third party, or part of our reusable development resources.

02 Project Ownership

Upon completion of the project and settlement of all applicable project payments, ownership or applicable usage rights for the agreed final project deliverables may be transferred to the client as specified in the project agreement.

The transfer of ownership applies only to those deliverables that are specifically identified as client-owned or transferable.

03 Client-Owned Materials

Materials supplied by the client remain the property of the client or their respective rights holder.

This may include:

• Company logos
• Branding materials
• Original photographs
• Videos
• Written content
• Product information
• Documents
• Business data
• Customer-provided graphics

The client is responsible for ensuring that it has the necessary rights and permissions to provide such materials for use in the project.

04 Project Deliverables

Project-specific deliverables created specifically for the client may include website pages, custom layouts, custom functionality, graphics, written documentation, and other items expressly included within the agreed project scope.

The exact ownership and usage rights for the final deliverables will depend on the agreed project scope, payment status, and any written agreement between the parties.

05 Payment & Ownership

Ownership rights for project deliverables are linked to the applicable payment obligations unless otherwise agreed in writing.

If a project has outstanding invoices, milestone payments, additional work charges, or other agreed dues, final ownership transfer or complete handover may be withheld until the outstanding amounts are cleared.

06 Source Code

Custom source code developed specifically for a client's project may be transferred to the client after completion of the applicable project payments, subject to the agreed scope and any third-party licensing restrictions.

Source code that forms part of our internal frameworks, reusable libraries, utilities, development systems, templates, or proprietary components may remain the property of WEB INDIA WEB MULTI SERVICES.

07 Reusable Components & Development Resources

During development, we may use or create reusable code, frameworks, libraries, functions, scripts, modules, templates, utilities, development techniques, or internal tools that can be used across multiple projects.

Unless specifically transferred through a written agreement, such reusable development resources remain the intellectual property of WEB INDIA WEB MULTI SERVICES.

08 Third-Party Assets

Websites and software projects may contain third-party materials that are not owned by WEB INDIA WEB MULTI SERVICES or the client.

These may include:

• WordPress themes
• Premium plugins
• Open-source libraries
• Fonts
• Stock images
• Icons
• Software libraries
• APIs
• External services
• Other licensed resources

Ownership and usage of these materials remain subject to the respective third-party license or terms.

09 Third-Party Licenses

Purchasing or installing a third-party asset does not necessarily transfer ownership of that asset to the client.

The client agrees to comply with applicable license conditions for themes, plugins, fonts, images, software, APIs, and other third-party resources included in the project.

10 Website Content

Original text, photographs, videos, product information, business information, and other content supplied by the client remain the responsibility of the client.

Where WEB INDIA WEB MULTI SERVICES creates original project-specific content as part of the agreed service, applicable ownership or usage rights will depend on the project agreement.

The client is responsible for ensuring that submitted content does not infringe the intellectual property or other rights of third parties.

11 Design & UI Assets

Website layouts, interface designs, visual compositions, graphics, and custom design elements created specifically for the project may be transferred according to the agreed project terms.

Design elements obtained from stock libraries, third-party marketplaces, design systems, fonts, icon libraries, or other external sources remain subject to their respective licenses.

12 Portfolio & Promotional Rights

Unless otherwise agreed in writing, WEB INDIA WEB MULTI SERVICES may display completed website or project work in its portfolio, website, social media, presentations, proposals, or other promotional materials.

If a client requires the project to remain confidential or does not want the completed work displayed publicly, the client should communicate this requirement before project completion.

13 Transfer & Handover

Website transfer, source-code handover, hosting transfer, domain transfer, database transfer, or migration to another developer or company may be subject to separate charges where applicable.

Ownership of the website does not automatically mean that all transfer, migration, technical setup, or handover services are free of charge.

14 Modification by Other Developers

After ownership or applicable usage rights have been transferred, the client may choose to appoint another developer or company to modify or maintain the website, subject to the licenses applicable to the project and its components.

WEB INDIA WEB MULTI SERVICES is not responsible for errors, security issues, data loss, compatibility problems, or other issues caused by unauthorized or improper modifications made by third parties after handover.

15 Confidentiality

Confidential project information received from a client will be handled with reasonable care and will not be intentionally disclosed to unrelated third parties except where required to provide the service, comply with applicable law, or as otherwise agreed.

Clients should clearly identify information that is intended to be confidential where special confidentiality requirements apply.

16 Project Cancellation & Termination

If a project is cancelled or terminated before completion, ownership and usage rights for unfinished work may remain with WEB INDIA WEB MULTI SERVICES unless otherwise agreed in writing.

Completed work may be subject to the payment and settlement terms applicable to the project.

Cancellation of a project does not automatically transfer all intellectual property rights associated with unfinished or unpaid work.

17 Ownership Disputes

If there is a disagreement regarding ownership, licensing, source code, design assets, or project deliverables, both parties are encouraged to first review the quotation, proposal, invoice, written agreement, project communications, and applicable policies.

The parties should attempt to resolve the matter through direct communication before taking further action.
